Effective date: October 26, 2026 Last updated: October 26, 2026
These Terms of Use (the "Terms") form a binding agreement between you and Vista Team Inc., a New York corporation with its principal place of business at Suffern, New York, USA ("Leshem," "we," "us," or "our"), governing your access to and use of the website located at https://leshemtype.com and any successor domain, together with all related services, accounts, downloads, and communications (collectively, the "Service").
PLEASE READ SECTION 15 CAREFULLY. IT CONTAINS A BINDING ARBITRATION AGREEMENT AND A CLASS ACTION WAIVER THAT AFFECT HOW DISPUTES ARE RESOLVED.
By accessing the Service, creating an account, or making a purchase, you agree to these Terms, our Privacy Policy, our Font License Agreement, our Refund Policy, and our Cookie Policy, each incorporated by reference. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract. If you use the Service on behalf of a company or other organization, you represent that you are authorized to bind it, and "you" refers to that organization.
2. The Service
Leshem operates an online marketplace offering licenses to digital Hebrew typefaces ("Fonts"). Some Fonts are created by Leshem and others by independent designers ("Designers") who distribute through Leshem. Unless stated otherwise, Leshem is the licensor and distributor of all Fonts offered on the Service, and the Designer is credited as the Font's author. Designers who provide Fonts are additionally bound by a separate agreement with Leshem.
3. Accounts
3.1 You may need an account to buy, download, or manage licenses. You agree to provide accurate, current information and keep it updated. 3.2 You are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly at hello@leshemtype.com of any unauthorized use. 3.3 Accounts are personal to you (or your organization) and may not be sold, transferred, or shared except as the applicable license expressly allows. 3.4 We may refuse registration, or suspend or close an account, as described in Section 14.
4. Purchases and Payment
4.1 What you buy. When you "buy" a Font, you purchase a license to use it under the Font License Agreement and the license tier you select. You do not buy ownership of the Font or any intellectual property in it. 4.2 Pricing. Prices are shown in U.S. dollars (USD) and may change at any time before you complete checkout. We may correct pricing or description errors and cancel orders affected by an obvious error, refunding any amount paid. 4.3 Payment processing. Payments are processed by Stripe, Inc. and its affiliates ("Stripe"). We do not receive or store your full card number. Your payment is also subject to Stripe's terms and privacy policy. 4.4 Taxes. Prices may exclude applicable sales, use, VAT, GST, or similar taxes, which you are responsible for unless we are required to collect them. 4.5 Delivery. Fonts are delivered digitally (for example, OTF, TTF, and/or WOFF2 files) via download link and/or your account after payment is confirmed. Delivery is complete when the files are made available to you. Download links may expire; you may re-download from your account while it is active, but we do not guarantee indefinite availability, so keep your own backup copies within the limits of your license. 4.6 Order acceptance. We may decline or cancel any order, including for suspected fraud, unauthorized or prohibited use, or export or sanctions concerns, and will refund any amount charged for a cancelled order.
5. Refunds
Because Fonts are digital goods that are delivered immediately and cannot be "returned," all sales are final except for the limited exceptions in our Refund Policy (a corrupted file we cannot fix or replace, or a duplicate charge). Once a font file has been downloaded, no other refunds are given. By completing a purchase you request immediate delivery and, where permitted by law, acknowledge that you lose any statutory right of withdrawal once download begins.
Chargebacks. If you initiate a chargeback or payment dispute without first contacting us in good faith, we may suspend your account and the related license until the dispute is resolved. A license for which payment is reversed is void.
6. Intellectual Property
6.1 The Service and all its content — including Fonts, font software, names, logos, specimens, text, graphics, and code — are owned by Leshem, its Designers, or its licensors, and are protected by copyright, trademark, and other laws. Except for the rights expressly granted in these Terms or a license, no rights are granted to you, by implication or otherwise. 6.2 "Leshem," "Leshem Type," and related logos are trademarks of Leshem. Font names may be trademarks of Leshem or a Designer. You may not use them without prior written permission, except to accurately identify a Font you have licensed. 6.3 Feedback. If you send suggestions or feedback, we may use them freely without obligation to you.
7. Acceptable Use
You agree not to, and not to permit anyone else to: (a) use the Service or any Font in violation of law or of the applicable license; (b) copy, distribute, share, resell, sublicense, or make available any Font except as the license permits; (c) use any Font, specimen, or other Service content to train, fine-tune, test, or improve any artificial intelligence or machine-learning model, or to generate fonts or glyphs; (d) scrape, crawl, data-mine, or automatically extract content from the Service, other than standard search-engine indexing; (e) circumvent or interfere with security, access controls, download limits, or license-tracking features; (f) probe, scan, or test the vulnerability of the Service, or introduce malware, or overload our infrastructure; (g) impersonate any person, create accounts by automated means, or use false payment information; (h) upload or submit content that infringes others' rights or is unlawful, deceptive, defamatory, hateful, or obscene; (i) use the Service to build a competing product by copying its content or Fonts.
8. User Content
If you submit content to the Service (such as reviews, profile information, or messages), you grant Leshem a worldwide, non-exclusive, royalty-free license to host, use, reproduce, display, and distribute that content in connection with operating and promoting the Service. You represent that you have the rights needed to grant this license. Fonts uploaded by Designers are governed by their separate agreement with Leshem, not this Section.
9. Third-Party Services and Links
The Service relies on third parties (such as Stripe, Supabase, Vercel, and Resend) and may link to third-party sites. We are not responsible for third-party services, sites, or content, and your use of them may be subject to their terms.
10. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL FONTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY FONT WILL BE COMPATIBLE WITH YOUR SOFTWARE, DEVICES, OR INTENDED USE, OR WILL RENDER IDENTICALLY IN EVERY ENVIRONMENT. YOU ARE RESPONSIBLE FOR TESTING A FONT BEFORE RELYING ON IT. Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.
11. Limitation of Liability
11.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, LESHEM, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, DESIGNERS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, OR THE COST OF REPRINTING OR REDOING ANY WORK, ARISING OUT OF OR RELATING TO THE SERVICE OR ANY FONT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 11.2 OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100). 11.3 These limitations do not apply to liability that cannot be limited by law, such as for fraud or for gross negligence or willful misconduct where such limitation is prohibited.
12. Indemnification
You will defend, indemnify, and hold harmless Leshem and its owners, officers, employees, agents, Designers, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service or any Font; (b) your breach of these Terms or any license; (c) your content; or (d) your violation of any law or third-party right. We may assume control of the defense at our own expense, and you will cooperate.
13. Changes to the Service and Terms
We may modify, suspend, or discontinue any part of the Service at any time. We may update these Terms; we will post the updated Terms with a new "Last updated" date and, for material changes, give reasonable notice (for example, by email or on-site notice). Changes apply going forward and do not affect licenses already purchased, which remain governed by the license terms in effect at the time of purchase. Continued use after the effective date means you accept the updated Terms. Changes to Section 15 will not apply to disputes already pending.
14. Suspension and Termination
14.1 You may close your account at any time by contacting hello@leshemtype.com. 14.2 We may suspend or terminate your account or access to the Service, with or without notice, if we reasonably believe you have breached these Terms or a license, created risk or legal exposure for us, engaged in fraud or chargeback abuse, or if required by law. 14.3 Termination of your account does not terminate a validly paid license unless you breached it; however, license breach may terminate the license as provided in the Font License Agreement. Sections that by their nature should survive (including Sections 4.4, 5–7, and 10–17) survive termination.
15. Dispute Resolution; Binding Arbitration; Class Action Waiver
15.1 Informal resolution. Before filing any claim, you agree to email us at hello@leshemtype.com with a description of the dispute and try in good faith to resolve it for at least 30 days. 15.2 Arbitration. Except as stated below, any dispute, claim, or controversy arising out of or relating to these Terms, the Service, or any Font or license ("Dispute") will be resolved by final and binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules (for consumers) or Commercial Arbitration Rules (for all others). The seat of arbitration will be New York County, New York, unless the parties agree otherwise; hearings may be held by video or in your county of residence if you are a consumer. The Federal Arbitration Act governs this Section. The arbitrator decides all issues except that a court decides questions about the scope, enforceability, and validity of the class action waiver. 15.3 Exceptions. Either party may (a) bring an individual claim in small-claims court if it qualifies, and (b) seek injunctive or other equitable relief in court to protect intellectual property rights or prevent unauthorized use of Fonts or the Service. 15.4 Class action waiver. YOU AND LESHEM AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. If this waiver is found unenforceable as to a claim, that claim will be severed and heard in court, not in arbitration. 15.5 Jury trial waiver. To the extent any Dispute proceeds in court, both parties waive any right to a jury trial. 15.6 Opt-out. You may opt out of this arbitration agreement by emailing hello@leshemtype.com within 30 days after you first accept these Terms, stating your name, account email, and that you opt out of arbitration. 15.7 Time limit. To the extent permitted by law, any Dispute must be brought within one (1) year after it arises.
16. Governing Law and Venue
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules, and by the Federal Arbitration Act. Subject to Section 15, the state and federal courts located in New York County, New York have exclusive jurisdiction, and you consent to personal jurisdiction there. The UN Convention on Contracts for the International Sale of Goods does not apply. Nothing in these Terms deprives a consumer of mandatory protections of the law of their country of residence.
17. General
17.1 Entire agreement. These Terms and the documents incorporated by reference are the entire agreement between you and us about the Service. If there is a conflict between these Terms and the Font License Agreement regarding the use of a Font, the Font License Agreement controls. 17.2 Severability. If any provision is held unenforceable, it will be enforced to the maximum extent permissible and the remainder will remain in effect. 17.3 No waiver. Our failure to enforce a provision is not a waiver. 17.4 Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets, or to an affiliate. 17.5 Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control. 17.6 Notices. We may give notice by email to your account address or by posting on the Service. Legal notices to us must be sent to hello@leshemtype.com and Suffern, New York, USA. 17.7 Export and sanctions. You represent that you are not located in, or a resident of, a comprehensively sanctioned country and are not on any U.S. government restricted-party list. 17.8 Language. These Terms are provided in English and Hebrew. In case of any inconsistency, the English version controls to the extent permitted by law.
